Seven Gust Rosenfeld Attorneys Named As 2010 Southwest Super Lawyers®


Seven Gust Rosenfeld lawyers were selected for inclusion in the 2010 Southwest Super Lawyers®.

Super Lawyers is a listing of outstanding lawyers from more than 70 practice areas who have attained a high degree of peer recognition and professional achievement. The following Gust Rosenfeld attorneys received this honor in 2010:

Christopher M. McNichol (Real Estate) - McNichol's practice emphasizes commercial and real estate transactions, including sale and purchase, development, lease, title insurance and construction issues, and related litigation in these areas. In addition, he handles creditors' rights matters, including loan workouts, judicial and non-judicial foreclosures, deeds in lieu, receiverships, deficiency and guarantor actions, short sales, and bankruptcy. He represents banks, mortgage lenders and brokers, title and escrow companies, real estate brokers and agents, developers, contractors, and individuals. He is the co-chair of the firm's real estate section. McNichol writes and lectures frequently at bar and industry seminars on real estate, litigation and creditors' rights topics. He graduated from Villanova University School of Law in 1986.

Sean P. O'Brien (Bankruptcy & Creditor/Debtor Rights) - O'Brien's practice emphasizes bankruptcy, restructuring, creditors' rights, and related litigation and appeals. He represents banks, savings and loans, mortgage lenders, corporations, partnerships and individuals in all areas of creditor and debtor relations. In 2009, he successfully petitioned and briefed the United States Supreme Court regarding the case of United Student Aid Funds, Inc. vs. Espinosa, the recent decision of which established legal requirements for the discharge of student loan debts in bankruptcy cases. O'Brien is Board Certified in Business Bankruptcy Law by the American Board of Certification, an American Bar Association-accredited program. In addition, he is an approved panel mediator on bankruptcy issues and a former Chair of the State Bar of Arizona's Bankruptcy Section. At Gust Rosenfeld, O'Brien serves as the practice group leader of the firm's Bankruptcy and Creditors' Rights and Litigation sections. He graduated from Valparaiso University School of Law in 1985.

Richard A. Segal (Business Litigation) - Segal concentrates his practice on commercial, insurance, and antitrust litigation. He represents insurance companies, financial institutions, businesses and individuals. He possesses extensive experience in both jury and non-jury trials of tort and antitrust cases, mediations, arbitrations, and appeals. He graduated from the University of Arizona College of Law in 1956.

Madeleine Wanslee (Bankruptcy & Creditor/Debtor Rights) - Wanslee's practice focuses on creditors' rights and related state and federal court litigation, including commercial and consumer bankruptcy, foreclosure, replevin, deficiency and guarantor actions, collections, and loan workouts. She also has handled numerous appeals on behalf of her clients. In 2009, she petitioned, briefed and argued the case of United Student Aid Funds, Inc. vs. Espinosa before the United States Supreme Court, the outcome of which established legal requirements for the discharge of student loan debts in bankruptcy cases. Wanslee is Board Certified in Consumer Bankruptcy Law by the American Board of Certification. In addition, she serves as a Lawyer Representative for the Ninth Circuit Judicial Conference (2008-2011 term) and is a former Chair of the State Bar of Arizona's Bankruptcy Section. She graduated from Gonzaga University School of Law in 1988.

Richard H. Whitney (Estate Planning & Probate) - Whitney's practice includes estate planning, probate, trust administration, and nonprofit organizations. In particular, he represents individual clients in legal matters involving the preservations and devolution of their property. He is a Fellow in the American College of Trust and Estate Counsel. Whitney received his MBA and law degrees from the University of Arizona in 1963.

Charles "Chas" W. Wirken (Appellate) -Wirken concentrates his practice on appeals in all areas and business litigation. Recently, he was selected as a Fellow in the American Academy of Appellate Lawyers. In 2009, he successfully petitioned and briefed the United States Supreme Court regarding the case of United Student Aid Funds, Inc. vs. Espinosa, the recent decision of which established legal requirements for the discharge of student loan debts in bankruptcy cases. He is admitted to practice before the United States Supreme Court and the United States Court of Appeals for the Ninth, Tenth and Federal Circuits. He is a former president of the State Bar of Arizona, a former chair of the State Bar's Trial Practice Section, and was a founder and officer of the State Bar's Appellate Practice Section. He is a 1975 graduate of the University of Arizona College of Law.
